Clerk of Courts

The County Clerk of Courts is an elected official with a 6-year term. This office has many responsibilities. For example, the Clerk is responsible for titling vehicles through the Title Division. In addition, the Clerk is the record keeper for the County Common Pleas Court and the Court of Appeals. The Clerk records all paperwork filed through the court and collects money for court fines and other costs. The Clerk also has authority to administer oaths and certify affidavits. The Clerk of Court also serves as a passport agent for the federal government.

Municipal Court

The Portage County Municipal Court is responsible for setting bonds on felony criminal cases and hearing misdemeanor cases. This court also hears civil suits involving up to $15,000 in damages. Small Claims Court is for claims up to $6,000.

Common Pleas Court

The Common Pleas Court hears criminal, civil, and administrative cases. The criminal division handles felonies, more serious misdemeanors, and capital murder cases. Civil cases include personal injury, disputes between businesses, disputes over property, and equity. Administrative cases include zoning, employment matters, and workers’ compensation cases.

Magistrates

Magistrates may be either appointed or elected to serve as judges in certain types of cases. By Ohio state law, a magistrate must have at least 4 years of practicing law and must be in good standing with the Ohio Bar and the Supreme Court of Ohio.

Civil Court

Civil cases are those that are not criminal in nature and usually involve a financial or property dispute between two people.

Municipal Court hears civil cases involving a maximum of $15,000. Small Claims Court is included with Municipal Court, hearing cases involving up to $6,000. Common Pleas Court hears civil cases involving more than $15,000.

Criminal Court

Criminal court judges hear cases involving criminal offenses. Municipal Court hears cases involving minor misdemeanors and infractions, while all other criminal cases are held in Common Pleas Court.

Domestic Relations Court

Cases heard in Domestic Relations Court most commonly involve separations and divorces. This includes legal separations, divorces and annulments, determining parentage, child custody and visitation, child support, parental rights, spousal support, and orders of protection.

Juvenile and Probate Court

In the state of Ohio, these two courts are grouped together. Juvenile Court hears cases regarding dependent children who have been neglected and/or abused, juvenile delinquency, and juvenile traffic infractions.

Probate Court issues marriage licenses. This court also hears cases involving the administration of estates, guardianships, mental health, and adoptions.

Drug Court

HOPE (Help, Opportunity, and Progress through Education) is a specialized drug court to help those who have committed relatively minor offenses related to substance abuse. Persons who have been charged with operating a vehicle while impaired, drug trafficking, sex crimes, and crimes involving a weapon and/or children are not eligible.

The program includes random drug testing, intensive substance abuse treatment, and regular reports to the court. Individuals will be placed on probation for a minimum of 16 months, and charges may be dismissed upon completion of the program.

Mental Health Court

STAR (Successful Treatment and Recovery Court) is a program through the Portage County Municipal Court. Offenders are placed on probation for a minimum of 12 months, while completing the program. The program includes mental health treatment, substance abuse treatment, and offering access to community resources. Upon completion of the program, the charges may be dismissed.
